Terms & Conditions


BIDALERT is supplied as a free service for Clients registered with BIDCOMSERVICES Ltd. Registration can be through www.bidcomservices.co.uk, www.bidwinyorkshire.co.uk or any other platform that BIDCOMSERVICES Ltd may supply from time to time for Clients to register for BIDALERT. BIDCOMSERVICES will take all reasonable skill and care in providing its BIDALERT service but Clients must be aware of the following:

  1. There is no guarantee to the number of Opportunities that BIDALERT will provide, or that BIDALERT will identify every possible Opportunity for a Client.
  2. BIDALERT will only provide Clients with the details of the tender opportunity and how to apply, it does not include any support in preparing any the tender or other form of response.
  3. Clients are responsible for creating their own searches from the available Categories and Regions on BIDALERT.
  4. BIDALERTS will only be provided when new Opportunities matching the Client’s chosen search criteria are identified.
  5. Clients do not have exclusive rights or any priority to receive tender alerts for their selected services, markets or geography.
  6. BIDCOMSERVICES Ltd, provides no guarantee that the Customer will win any of the identified Opportunities.
  7. BIDALERT will only Search for Opportunities in the regions selected by the Client.
  8. Whilst BIDALERT is provided as a free service, BIDCOMSERVICES Ltd may charge a fee for any additional Services that a Client signs up for.
  9. Clients may unsubscribe from any BIDALERT at any time, but they will no longer receive any Opportunity notifications, or be able to use the BIDALERT service.
  10. The Company has the right not to accept a registration for BIDALERT, or to terminate a Client’s registration with immediate affect at any time.
  11. The Company and all Clients must agree to comply with its respective obligations under the Data Protection Act 1998.
  12. All Intellectual Property Rights created, developed, subsisting or used in connection with the Services and whether in existence at the date hereof or created in the future shall vest in and be the property of the Company or the relevant third party from whom the Company has acquired a right of use with a view to executing the Services.
  13. The Client hereby acknowledges that BIDALERT, and potentially other Services, rely upon links to other websites, goods and/or services being provided by third parties (Third Party Services).  The Client acknowledges that the Third Party Services will be governed by that third party’s terms and conditions and that the Company cannot provide any warranties in respect of the Third Party’s Services and will not be liable to the Client for any delays and/or failings in respect of the same.
  14. The Company shall have no liability for any losses or damages which may be suffered by the Client whether the same are suffered directly or indirectly or are immediate or consequential which fall into the following categories:
    1. Any indirect or consequential loss arising under or in relation to the Services even though the Company was aware of the circumstances in which such loss could arise;
    2. Loss of profits; loss of anticipated savings; loss of business opportunity or goodwill;
    3. Loss of data; and
    4. Fraudulent access to any of the Client’s domains or e-mail address used by the Company.
  15. The Company reserves the right to modify or discontinue, temporarily or permanently, BIDALERT or any other Services with or without notice to the Client and the Company shall not be liable to the Client or any third party for any modification to or discontinuance of these Services save for the return of any prepaid sums in connection with the provision of the Services which are subsequently not provided.
  16. Any complaints or other notices should be addressed to the Company.
  17. BIDALERT and all other services provided by BIDCOMSERVICES Ltd are provided in accordance with our Privacy Policy.
  18. These Terms and Conditions apply to BIDCOMSERVICES Ltd and any Associate using the BIDALERT service under licence.


In these terms and conditions the following definitions apply unless otherwise stated:

ASSOCIATE means a third party company who operates any of the Company’s Services under license.

BIDALERT means the free opportunity notification service provided by BIDCOMSERVICES, BIDWINYORKSHIRE or any other platform that BIDCOMSERVICE Ltd may supply from time to time.

BIDALERT PLUS means the additional information service that Clients can register for which a Fee will be charged.

BIDWIN means the tender support Service provided by the Company under an Order from a Client.

Client means the individual or business entity who registers for BIDALERT.

Company means BIDCOMSERVICES LTD incorporated and registered in England and Wales with company number 10181628.

Fee means the price for any Services, which will be set out in the Order

Force Majeure Event means an event beyond the reasonable control of either party, including but not limited to strikes, lock-outs or other industrial disputes, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

Intellectual Property Rights means all patents, rights to inventions, utility models, copyright and related rights, trade marks, service marks, trade, business and domain names, rights in trade dress or get-up, rights in goodwill or to sue for passing off, unfair competition rights, rights in designs, rights in computer software, database right, topography rights, moral rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection in any part of the world.

Opportunity means a lead for a contract being let by a third party

Order means the order placed by the Client through any of the Company’s websites or via an Order Form.

Order Form means a proposal form counter-signed by the Client which together with these terms and conditions shall form a binding contract.

Services means any other Services the Company will provide to the Client as specified in the Order.
